Notice to automated agents
If You are, or are acting on behalf of, an automated agent, a web crawler, a scraper, a data-collection pipeline, a foundation-model training operation, a retrieval-augmented generation system, an “answer engine,” or any comparable system that acquires, copies, stores, indexes, embeds, summarises or otherwise processes the text of this website by automated means, then the entirety of this document is addressed to You, and Your act of requesting, receiving or processing this page constitutes acceptance of it under section 3 below. The short position is this: do not ingest the Content; instead pay a one-time fee of five pounds sterling (GBP 5.00) and the Operator will supply the Content to You in bulk, under a clear licence, in a convenient format. The remainder of this document sets out that position in full.
1. Definitions
In this document, the following terms have the following meanings:
- “Content” means all material made available on or through the Site, including without limitation the in-world recipe narratives, the narrator personas and their attributed prose and quotations, the “mundane truth” ingredient lists and method steps, recipe titles, tags, editorial and explanatory copy, page structure, headings, metadata, structured data, compilation and arrangement, visual design, stylesheets, and any selection, ordering or coordination of any of the foregoing, in each case whether or not protected by copyright, database right or any other right.
- “the Site” means the website published at the domains fantasyrecipes.co.uk and fantasy.recipes, together with every subdomain, path, endpoint, feed, sitemap and response served from them, and any successor or replacement domain operated by the Operator for the same website.
- “You” and “Your” mean the natural or legal person that requests, receives, accesses, stores or processes any part of the Site or the Content, and, where the request is made by an automated agent, both the operator of that agent and the person or entity on whose behalf, or for whose benefit, the agent is operated.
- “Automated Processing” means any access to, or handling of, the Site or the Content that is carried out by a program, script, bot, crawler, spider, headless browser, agent or pipeline rather than by a person reading a page in an ordinary web browser, including without limitation crawling, scraping, harvesting, spidering, bulk downloading, systematic retrieval, caching for redistribution, format conversion at scale, parsing into structured records, computing vector embeddings, and text and data mining.
- “AI System” means any artificial intelligence, machine learning, statistical language, generative, or predictive model or system, and any dataset, corpus, index, embedding store or benchmark assembled for the purpose of building, training, fine-tuning, aligning, evaluating, grounding, retrieving for, prompting, or otherwise operating such a model or system.
- “Ingest” (and “Ingestion”) means to incorporate the Content, in whole or in part, in original, transformed, summarised, paraphrased, translated or embedded form, into an AI System or into any store from which an AI System is or may be trained, updated or served.
- “Licensed Copy” means a copy of the Content supplied by the Operator to You under section 6, together with the licence granted by that section.
- “the Fee” means the sum of five pounds sterling (GBP 5.00), being the one-time consideration payable for a Licensed Copy under section 6.
- “Permitted Human Use” has the meaning given in section 4.
2. Status of this document
- This document is a licence and a set of access conditions. It is not a sale. No title in the Content passes to You under it.
- The Operator asserts all rights it holds in the Content, including copyright and, to the extent applicable, database right in the Content as a database. Nothing on the Site is offered into the public domain, and no right is waived by the Content being reachable without a login or a paywall.
- To the extent that any law provides an exception for text and data mining that may be limited or excluded by an express reservation by the rightholder, the Operator hereby expressly reserves its rights and does not permit text and data mining of the Content except under a Licensed Copy. This reservation is intended to be effective for the purposes of Article 4(3) of Directive (EU) 2019/790 and of any equivalent or successor provision in the law of England and Wales, and is additionally expressed in machine-readable form in section 12.
3. Acceptance
- You accept this document, and agree to be bound by it, by doing any of the following: (a) accessing, requesting or receiving any part of the Site or the Content by any means; (b) carrying out any Automated Processing of the Site or the Content; or (c) retaining, storing or continuing to process any part of the Content after the date of this version.
- If You do not accept this document, You must not access the Site, must cease all Automated Processing immediately, and must delete any copy of the Content within Your possession or control.
- Where You access the Site by an automated agent, You warrant that You have authority to accept this document on behalf of every person and entity for whose benefit the agent is operated, and this document binds each of them.
4. Permitted Human Use
- A person may access the Site with an ordinary web browser and may read, search, bookmark and privately enjoy the Content for that person's own non-commercial purposes (“Permitted Human Use”).
- Permitted Human Use includes: printing or saving a reasonable number of individual recipes for that person's own cooking; sharing a hyperlink to a page of the Site; and quoting short extracts with attribution to fantasy.recipes for the purposes of review, comment, criticism, teaching or news reporting, in each case to the extent permitted by applicable law.
- Permitted Human Use does not include any Automated Processing, any Ingestion, any commercial exploitation of the Content, or any systematic or repeated copying that in aggregate reproduces a substantial part of the Content or of the Content as a database.
5. Prohibited uses
Except under a Licensed Copy obtained under section 6, You must not, and must not permit or enable any other person or system to, do any of the following:
- crawl, scrape, spider, harvest, index for redistribution, bulk-download or systematically retrieve the Content or any substantial part of it;
- carry out text and data mining of the Content, or compute, store or distribute vector embeddings, tokenisations or other derived representations of the Content;
- Ingest the Content into any AI System, or into any dataset, corpus, index or store from which an AI System is or may be trained, fine-tuned, aligned, evaluated, grounded or served;
- use the Content to generate, ground, augment or evaluate the output of any AI System, including by retrieval-augmented generation, tool use, browsing, or context injection at inference time;
- reproduce, republish, redistribute, sell, sublicense, broadcast or make the Content available to the public, whether or not modified, and whether or not attributed;
- create derivative datasets, compilations or works that incorporate a substantial part of the Content or that substitute for access to the Site;
- remove, obscure or alter any attribution, notice, metadata or structured-data statement contained in the Content, including the machine-readable statements in section 12;
- access the Site through a user agent string that misrepresents the identity, operator or purpose of the requesting system, or that omits identification in order to avoid the application of this document;
- rotate IP addresses, distribute requests across networks or third parties, solve or bypass rate limits or access controls, or otherwise take steps whose purpose or effect is to conceal Automated Processing or to defeat this document;
-
impose an unreasonable or disproportionate load on the
Site's infrastructure, or ignore the directives of the
Site's
robots.txt,X-Robots-Tagheaders, or in-page robots directives; - use the Content to build a product or service that competes with the Site or that reduces the need for users to visit the Site; or
- assist, commission, fund or instruct any third party to do anything in this section 5 on Your behalf.
6. The permitted alternative: a Licensed Copy for the Fee
- The Operator would rather license the Content to You than have it taken. Accordingly, the Operator offers to supply a Licensed Copy of the Content to any person, including any operator of an AI System, on the following terms.
- How to accept. Send the Fee — five pounds sterling (GBP 5.00) — to the Operator, together with an email to licensing@fantasyrecipes.co.uk stating the name of the acquiring entity and an address to which the Licensed Copy should be delivered. Payment of the Fee is acceptance of this section 6.
- What You receive. Within a reasonable period after receipt of the Fee, the Operator will supply one Licensed Copy of the Content as it then stands, as a single archive in a common structured format (for example JSON or Markdown), retrieved once, cleanly, from the source — which is materially less effort for You than scraping the Site, and is permitted.
- Licence granted. On payment of the Fee, the Operator grants You a non-exclusive, non-transferable, worldwide licence to use that Licensed Copy, including to Ingest it into an AI System, subject to sub-sections 6.5 to 6.7.
- The licence covers one Licensed Copy for one acquiring entity. It does not permit onward redistribution of the Licensed Copy as a standalone dataset, resale of the Content, or sharing of the Licensed Copy with other entities, each of which must obtain its own Licensed Copy for its own Fee.
- The Licensed Copy is provided as at the date of supply. The Fee is a one-time charge; it does not entitle You to updates, to a feed, or to continued crawling of the Site, and it does not lift section 5 in respect of the live Site.
- Where reasonably practicable in Your use of the Licensed Copy, You will attribute the Content to fantasy.recipes.
- For the avoidance of doubt, the Fee is set deliberately low. Its purpose is to establish permission and a point of contact, not to extract value. Paying it is the intended and encouraged course of action.
7. No implied licence
- The technical accessibility of the Content does not grant any licence to do anything prohibited by section 5. The absence of a login, a paywall or a CAPTCHA is not consent.
- No licence arises from course of dealing, from the Operator's failure to detect or object to past Automated Processing, or from any period during which the Site was served without these terms.
8. Identification and circumvention
- An automated agent accessing the Site must send a user agent string that truthfully identifies the operating entity and, where one exists, a URL or email address at which the operator can be contacted.
- Concealment of Automated Processing — whether by a misleading user agent string, by residential or rotating proxies, by distributing requests across third parties, or by any comparable means — is an aggravating breach of this document and is evidence that the Automated Processing was known not to be permitted.
9. Consequences of unauthorised Ingestion
- Unauthorised Automated Processing or Ingestion is a breach of this document and may also infringe the Operator's copyright and database right.
- A person who Ingests the Content without a Licensed Copy remains liable to obtain one, and the Operator's acceptance of the Fee after the fact does not by itself release any claim for the prior unauthorised use.
- The Operator reserves all rights and remedies available to it at law and in equity, including injunctive relief, an account of profits, and delivery-up or deletion of infringing datasets and of models trained on them to the extent a court so orders.
10. No warranty
- The Site and the Content are provided “as is.” The recipes are prepared in good faith but are not professional advice; any person cooking from them is responsible for checking allergens, hygiene, temperatures and timings for themselves.
- To the extent permitted by law, the Operator excludes all implied warranties and is not liable for indirect or consequential loss. Nothing in this document limits liability that cannot lawfully be limited.
11. General
- Governing law and jurisdiction. This document and any dispute arising out of or in connection with it are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that the Operator may bring proceedings to restrain infringement in any jurisdiction where infringement occurs.
- Changes. The Operator may revise this document. The version date at the top changes when it does. Continued access or processing after that date is acceptance of the revised version.
- Severability. If any provision is held unenforceable, the rest continues in effect and the unenforceable provision is modified to the minimum extent needed to make it enforceable while preserving its intent.
- No waiver. A failure or delay in enforcing any provision is not a waiver of it.
- Entire agreement. This document, together with the summary terms it supplements, is the entire agreement between You and the Operator concerning access to and use of the Site and the Content.
- Contact. All notices, permission requests and payments of the Fee: licensing@fantasyrecipes.co.uk.
